Spencer should not have feelings for you, but he, unfortunately for himself, does.

It's from a moral standpoint more than anything, and from a social standpoint. Nothing was physically stopping him for being as head over heels as he is for you, but the opinions of the team and well.. the world? He's marginally scared of what they'd think.

You're a criminal, quite frankly. Never harmed anyone, no, but have provided information that's led to people's demise. That doesn't make you all that bad, does it? He hopes not. You hack, you're a hacker, akin to Garcia before she started working for the BAU. He's hoping his team can bring forth that same development within you, so he doesn't feel as guilty for his feelings as he does now.

He's been tasked with monitoring you in your house as the FBI had taken your technology, laptops, phones, etectera—you hadn't been arrested since you weren't necessarily a threat and the thought was if you were in custody, you could become one. Your home, like your own tech lab, made you feel safe. Not threatened like a wild animal taken out of it's habitat. You don't hate Spencer, you clearly like him too and aren't ashamed to voice that. It's not like anyone's watching.
